1. Union Election Commission received the letters of objection from 13 political parties and 14 individuals to take necessary actions against Daw Aung San Suu Kyi, State Counsellor and Union Minister for Foreign Affairs, U Tin Oo, the Patron of the National League for Democracy, and U Win Htein, member of secretaries, accusing that their performances as regards the by-election held on 1st April 2017 are tantamount to violation of the prescriptions included in the Constitution, law on registration of political parties and Law on Union Election Commission.


2. Union Election Commission took time to study, scrutinize and assess the matter in detail in accord with laws, codes and prescriptions over performances of the accused, which were tantamount to violation of the prescriptions described in the letters of objection.

3. The UEC assessed and found that these letters of objection were attributed to the designation of 1st April 2017 as 2017 by-election day, according to the discussions.

4. Union Election Commission is the organization which has been exercising duties and authorities assigned upon by the Constitution and related laws openly, as regards the process on election. Designation of 1st April 2017 (Saturday) as 2017 by-election day was made according to some nationals’ suggestions, saying that it coincides with the 2012 by-election day and they suggested that elections should not be held on Sunday. Union Election Commission hereby clarified that the designation of the election date is not due to the suggestions or instructions of the State Government, a political party or any individual persons.

5. It is customary for heads of the government, responsible persons of the winning party to make clarifications on the report of the one-year performances and further working process to the public.

6. It has been found that such letters of objection emerged due to the coincidence of designated date of 2017 by-election by the UEC with the time reaching one year period when the government took office. And, it has been found out that clarification of the State Counsellor and responsible officials of the winning party has not been tantamount to activities launching election campaign.

7. Accordingly, Union Election Commission hereby notified that there has no actions to be taken against the accused, over the letters of objection.
